I was thinking the HISA rules weren't due to go into place until later this month, but maybe that's the testing policy portion of things....

Trainer scratches (Equibase chart) and vet scratches treated differently. Forte connections will be arguing it was a trainer scratch.

@reredevaux 2/2 This sounds easy enough- work for the vet in NY, pass exams, blood etc. However, if they want to be difficult they can be. I had an issue with a horse that worked off satisfied the Vets in the state but it still wasn’t up to what KY wanted. I had to fight to run the horse. 6:41 PM · May 7, 2023 ·

Interesting change today. Read this earlier today before the chart change. From Blood Horse: The KHRC statement Monday does not agree with the listing in the official chart for the 149th Kentucky Derby. The chart lists five scratches from the classic and attributes each of those decisions not to run to the "trainer."

Interesting change today. Read this earlier today before the chart change. I don't have a screenshot of the "before chart".

The original chart had Forte as a trainer scratch.

Yeah, this is going to get interesting for sure....
I am fairly confident this turned into a pissing match between Repole and the state vet. It was likely suggested (strongly) they trainer scratch, connections refused and forced KHRC vet's hands resulting in the vet scratch. Equibase put it in as trainer scratch and that was amended yesterday.
A vet scratch has an entirely different set of rules versus a trainer scratch including a 14-day competition stand down, a requirement to pass a phsyical exam, and a blood panel, and a requirement to work for state vet and be passed to come off the vet list at the end of 14 days. All of this could happen if lawyers do not get involved... He can work in the interim for the state vet, get approval, have the labs performed, and will likely even utilize the PET scan now at CD for further validation there is nothing structurally going on with the right front fetlock, aside from the reported foot bruise. Hopefully this is all resolved quietly, not in the media, and with the best interest of the horse at the center.

The video of Repole and the State Vet was pretty amazing . Todd Pletcher ‘s look said “ get me out of here”. Presumably if they had scratched as soon as the bruise was first apparent they could have gone straight to Preakness without all this fandango.

Now, not possible. He will not run. Too much of a pissing contest and too many egos involved. And after today's news, rest the horse a bit, bring him back and run in the Dwyer and Haskell before he is retired would be my guess, if he's brought back at all.

May 11th: BloodHorse reported that The New York State Gaming Commission suspended Hall of Fame trainer Todd Pletcher and disqualified Forte from his win in the Grade 1 Hopeful Stakes last fall because of a positive drug test. Suspended for 10 days and fined $1,000.
"After the Sept. 5 Hopeful, Forte tested positive for meloxicam, a nonsteroidal anti-inflammatory medication, according to the report. That victory at Saratoga was the first in a five-race win streak that included the Breeders' Cup Juvenile and 2-year-old male championship for Forte.
The action by the gaming commission had not been posted on its website as of mid-afternoon Thursday. Pletcher and his attorney, Karen Murphy, could not be reached for comment."
at any rate, given procedural delays, we will never know *when* a horse is going to lose the purse from a race they "didn't win" because of drugs, and of course, bettors don't get their $$ back.
I certainly feel safer going forward, betting into places where there is a lot of transparency, and unfortunately, that doesn't seem to include US racing at the moment.
38 something different states and all have different rules. I don't even know how trainers can keep up with all this baloney. We need one set of rules that applies to ALL. (IMHO)
"These are the rules. Follow them. " Seems to make things a lot more clear, makes scheduling easier, and then freeze samples for at least 5 years in case testing technology isn't keeping up with the chemists (both veterinary and feed guys) which may come into play as well. And, no procedural delays that require months and months of BS with attorneys, etc. Use the best testing technologies known to the world in present modern time and that's that.

thehorse.com/115420/meloxicam-vs-phenylbutazone-effects-on-horses-gastric-mucosa-studied/Seems similar for humans who cannot take non-steroidal NSAIDs.....which can really put some holes in your stomach for some of us at risk, or maybe many of us, actually. As we age the mucosa does thin out, so easier to get perforations in stomach or colon. I myself don't pop OTC NSAIDs myself as I've been warned by too many good rheumatologists that we may be trading aches and pains for something much worse.
