In 2009, Amon sentenced disgraced NBA referee Tim Donaghy to 15 months in Federal Prison for his role in fixing NBA games. She was also chief of frauds from 1978 to 1980, and then chief of general crimes from 1981 to 1982. (As an Assistant United States Attorney of the Eastern District of New York)

For the most part, these things fall into the rubric of "Administrative Law." There are certainly a bunch of regulations relating to licensing trainers and racing horses. For the most part, disputes are handled administratively and the courts do not want to be involved. As such, access to the courts is generally constrained to a violation of the Agency's own rules, arbitrary or capricious decisions or constitutional violations. So, they can't simply deny him stall space, there has to be a reason to do so and the process must be followed. However, the reasons or basis for the denial of stall space may be somewhat amorphous and broadly worded to allow discretion among the Agency. But the more broadly worded the guidelines or tenets are the more the Agency is open to legal challenge.

Sadly I am totally not surprised that there are "problems" associated with the additional testing, the little left to test with and the posturing taking place. Baffert may yet slime is way out of this one.

NYRA attorney Henry Greenberg pulled no punches during his opening statement.
“Baffert took a wrecking ball over a two year period to the integrity of a sport that was so good to him,” Greenberg said.
“He sullied and soiled in one year, 365 days, three of the great races in America, the Arkansas Derby, Kentucky Oaks and the Kentucky Derby.”

So what's his plan with the prep runners getting no Derby points? Is he gonna to do the sham trainer transfer and let them earn 50/100 points in the last round under another trainer...then run in the Derby? I guess the owners would play along for a while, but a bad look for CDI if Baffert can pull that off. Might be worse for CDI if the owners of the best horses DON'T go to the Derby and leave a questionable field, but what do the owners gain by staying loyal to Baffert?

Aren't tracks allowed to decide who they let run ? Couldn’t they just deny him stall space? SA did deny him stall space. Baffert had to take his sign down. Then, m all his owners transferred their horses to trainers Tim Yakteen and Sean McCarthy at SA, so they could continue to enter the KY Derby and Oaks and other races. Sean McCarthy's wife is Baffert's office manager/accountant, so I'm gonna betcha she had quite a lot of toilsome paperwork to do. 91 days from April 4th, Baffert can go hang his sign up again at his barn at SA when his "suspension" is over. I don't know if the horses are in the same stalls or not, but I guess it won't be too hard to walk everybody back where they *belong*. Ho hum. By July nobody will be talking about it. (I hate emoticons but sometimes I am grateful to forums for having them. )
